It DOES MATTER Where Your Bank Levy is Served, and WHO Serves It!
WE GET THE JOB DONE RIGHT, AND PUT YOU BACK IN CONTROL!
Effective January 1, 2013 California Code of Civil Procedure Section 684.115 requires financial institutions with more than 9 branches or offices and allows financial institutions with 9 or fewer branches or offices to file with the Department of Business Oversight (DBO) one or more central locations within California that are designated for service of legal process. This law applies to financial institutions, including state or national banks, state or federal savings and loan associations, credit unions, or like organizations, and corporations engaged in safe deposit businesses. “Legal Process” refers to each and all of the writs, notices, orders, or other papers required or permitted to be served pursuant to Title 9, including adverse claims as to deposits and safe deposit boxes.
What this means to you is if you have an Bank Levy or other "Legal Process" that must be served on a bank (like Bank of America) who has designated a central location for service of process in Los Angeles County, you will need to have that document served in L.A. County by either the Sheriff of Los Angeles, or a Registered Process Server. The Los Angeles County Sheriff's Department is currently backlogged approximately 3 months for levy service. If you choose to use the Sheriff, Your writ might very well expire before it is even served!
Your other option is to use a Registered Process Server to levy the bank accounts. We serve legal process on banks in Los Angeles County on a RUSH basis. This means that your levy will be served, and funds will be held when YOU want it done, rather than when the Sheriff gets around to it. You Are In Control!
To find out where your levy must be served, Click Here for a Statewide List Of Designated Central Locations for Service Of Process. If your institution is not included on the list, you can have it served at any branch. We can help you with this as well. If the bank you want to serve is not listed, and they have a branch in Ventura County, you can have a writ issued for Ventura County and we can serve it for you at the discounted Ventura County rate! Call 877-459-1083 for more information.
Bank Levy Service in California is a Complex Matter!
WE DO IT QUICK AND WE DO IT RIGHT!
This is the process: You provide us with a Completed Levy Packet. We double check your paperwork. If we receive the packet by close of business on Tuesday, your file with the Sheriff will be opened on Wednesday. Your Levy will then be served that Wednesday. L.A. County LEVIES ARE SERVED ON WEDNESDAY, or THURSDAY, but the cut off for paperwork to be in our office is 5:00 PM on Tuesday. Ventura County Levies are served throughout the week. Santa Barbara and Kern County Levies are served on a case by case basis.
IF YOU HAVE TO HAVE IT DONE "NEXT DAY" WE CAN HELP!
We do offer "Next Day" Service of Los Angeles County, Ventura County, Santa Barbara County and Kern County Bank Levies. The cut off time for this service is 11:30 AM the day before you need the document served. In some cases, Next Day service can be effected on the day the Levy Packet is received in our office (same day). Our preference is to serve the document on the day it is received, however because of the waiting time to open files with the L.A. County Sheriff's Department (up to a 6 to 7 hour wait in line) we cannot guarantee same day or one day service. If we can do it, we will, because it will save us an extra trip, but no promises! The charge for Next Day Service is $499.00 plus $24.00 parking fees (L.A. County Only). Why a Parking Fee?
We Get It Out For Service When We Get It In For Service!
WE SET THE STANDARD FOR CUSTOMER SERVICE !
We Only Have One Speed—RUSH! Fast and Faster! That’s how we operate. Our slowest service available is RUSH! And the GOOD NEWS is that our $259* Flat Fee for RUSH L.A. County Bank Levy Service is about the same as the other guys charge for standard L.A. County Bank Levy Service. Why do we do this? Because We Set The Standard for customer service! RUSH SERVICE is the standard we have set for L.A. County Bank Levy process serving! Why let your levy sit around on a desk, when they can be served, and account deposits seized? Our policy is “WE SET THE STANDARD FOR CUSTOMER SERVICE !”
*plus $12.00 parking fee
So How Much Total Will It Cost?
